IN-HOME SUPPORTIVE SERVICES (IHSS):
* ASSEMBLY SUBCOMMITTEE REJECTS GOV'S IHSS FUNDING FREEZE PROPOSAL

SACRAMENTO  -  With the chair urging immediate action, the Assembly Budget Subcommittee #1 on Health & Human Services voted without opposition to firmly reject the Governor's proposal to freeze the State's level of funding for In-Home Supportive Service (IHSS) worker wages and benefits at the level it was as of January 10, 2007 in a hearing packed with several hundred people with disabilities, IHSS workers, Service Employees International Union (SEIU) and United Domestic Workers union representatives, and other disability and senior advocates.

The action came after dozens of people with disabilities, seniors, IHSS workers and other advocates  testified in opposition and about the impact of the Governor's proposal that they said would freeze worker wages and result in loss of workers, services and rights.  Over 370,000 children and adults with disabilities (including developmental), seniors, persons with traumatic brain and other injuries, persons with MS and other health needs, the Blind and others receive In-Home Supportive Services that allows them to remain in their own homes instead placement in a nursing home or similar facility. Over 320,000 persons, some of them family members, are IHSS workers. 

The subcommittee held "open" all other IHSS proposals and issues on the agenda (see below for details) for action at a later hearing probably early next month.


Subcommittee Chair Berg: Proposal "So Far Out of Step In Our Values and Priorities"
Assemblymember Patty Berg (Democrat - Eureka, 1st District), chair of the subcommittee said that while many major budget proposals from the Governor are being held "open" until he releases his revisions to his proposed budget in early May, the IHSS funding freeze proposal  was "so far out of step in our values and priorites" that it needed to be rejected immediately.  She said that the proposal would mean that IHSS recipients and workers would be asked to "unfairly shoulder the burden" of the State's budget problems.

Assemblymember Hector De La Torre - who chaired the subcommittee last year, made the motion saying that the subcommittee had "no intention" of approving the Governor's IHSS funding freeze proposal and and agreed with Berg that they should act to reject it now.  Even Assemblymember Bill Maze - a conservative Republican - while saying the issue should remain open until the Governor's revisions in May, expressed concerns with the IHSS Funding Freeze proposal and did not vote against the action of the subcommittee. Assemblymember Jim Beall (Democrat - San Jose), who also chairs the Assembly Human Services Committee and like Maze, was a former county supervisor, also spoke in strong support of rejecting the proposal. 

While not specifically rolling back or freezing IHSS worker wages, the impact of the Governor's proposal, according to advocates, would be to freeze State funding to the counties for the main costs of the IHSS program - and counties will  be unable to provide the additional funding for future IHSS worker wage and benefit increases.


Hearing Covered Several IHSS Related Issues and Developmental Services

* As reported in a previous CDCAN Report Wednesday evening, the hearing began at 1:30 PM, covering the IHSS issues, and ended just before 7 PM, ending with testimonies on the closure and transition plan of Agnews Developmental Center in San Jose, by over 40 parents, family members of persons residing at Agnews Developmental Center, and other advocates, provider representatives, regional centers and others.  [see separate CDCAN Report for details and also for update on regional center or developmental center related bills having action since April 1]
* The subcommittee, chaired by Assemblymember Patty Berg (Democrat - Eureka), will hear the budget items under the Department of Developmental Services (regional centers and developmental centers) that was scheduled to be heard today (April 11) instead in early May, possibly May 9.

Stunning Rejection of Schwarzenegger Administration's Budget Proposal
The vote on the IHSS budget issue  was a stunning rejection of Schwarzenegger Administration because  neither of the subcommittee's two Republicans - both conservatives -  voted to support the Governor's plan.  Assemblymember Bill Maze (Republican - Visalia, 34th District)  voted to abstain as he wanted to keep the issue open until the Governor submits revisions in May to his proposed budget for 2007-2008 - but even Maze, a conservative Republican, expressed reservations about the Governor's proposal. 
Assemblymember John Benoit (Republican - Riverside, 64th District) either voted with the Democrats to oppose the Governor's proposal or withheld his vote as Maze did (during the hearing, as CDCAN reported earlier, it sounded and appeared that Benoit voted "aye" - though later unofficial committee records seem to indicate he either abstained or did not vote (though he was present).

Next Steps - Pressure on Senate to Reject Governor's IHSS Proposal April 19th
* The Senate Budget Subcommittee #3 on Health and Human Services is scheduled to hear and possibly act on the Governor's proposal on April 19. [see CDCAN Alert on this issue and CDCAN Townhall Telemeeting]
* If the Senate subcommittee takes the same action as the Assembly, the issue would largely be dead (though anything can happen during the budget process).  [see CDCAN Alert on this and special townhall telemeeting]
* The action by the Assembly signals that the related legislative bill, SB 782 by Sen. Cogdill that contains a slightly revised version of the Governor's IHSS proposal, is also likely dead. The Schwarzenegger Administration indicated in January that it would introduce legislation to change State laws in order to move forward with its proposal to freeze IHSS state funding - though the proposal itself would also be the subject of separate budget hearings. 
* That bill was introduced and referred to the Senate Labor and Industrial Relations Committee for a policy review of the issue - but with the strong Assembly action the issue at least in the bill, is all but dead. The bill was heard Mach 28, with testimony taken - but no action taken and the bill was held in committee, with a further hearing to be set (though as of 4/12/07 no date has been scheduled).

Subcommittee Hearing Agenda Issue #1: IHSS Program Overview and Caseload
The Department of Social Services reported:
* 326,120 persons who are IHSS workers (providers), providing over 30 million hours of service a month.
* 374,000 (average monthly caseload) children and adults with disabilities, seniors and other eligible persons receiving IHSS services (estimated number for State budget year beginning July 1, 2006 and ending June 30, 2007). Of that number, 347,767 persons receive IHSS under the Personal Care Services Program and Independence Plus Waiver Program and 27,232 persons receive IHSS under the residual program.

* Item was held open until May, for updated IHSS caseload estimates that will be released as part of the Governor's revisions to his proposed budget in early May (referred to as the "May Revise" or the "May Revision")

Subcommittee Hearing Agenda Issue #2: Prosposed Freeze of State Participation in IHSS Worker (Provider) Wages & Benefits

Action Taken By Assembly Budget Subcommittee 04/11/07:
* Heard from panel including an IHSS recipient, SEIU, UDW, Resources for Independent Living, Protection and Advocacy Inc, California Welfare Directors Association, Legislative Analyst Office, Department of Social Services - and from dozens of persons from the public including IHSS workers (providers), union representatives, community-based providers, family members, persons with disabilities, seniors, other advocates. 
* VOTED 4-0*: Rejected the Governor’s proposal to freeze State participation in IHSS worker (provider)  wages and benefits at  January 10, 2007 levels (as result maintaining exisitng State law).  *- CDCAN's record of meeting shows 5 votes for, with Mr. Maze present but not voting.  
* In addition, the subcommittee requested from the Department of Social Services specific information - with preliminary data to be provided by April 30th, on the costs that have been avoided in institutionalization spending as a result of the IHSS program, since its enactment. 


Subcommittee Hearing Agenda Issue #3: Assessment of IHSS Quality Assurance Initiative
As part of the 2004 State Budget, IHSS Quality Assurance Initiative was created (SB 1104 - the 2004 budget related or trailer bill) to improve accuracy of needs assessments and program integrity with statewide uniform standards for tools used and training for county social workers. 
Action Taken By Assembly Budget Subcommittee 04/11/07:
* Heard testimony from panel and from a recipient of IHSS and a parent of an adult with developmental disabilities who recieves IHSS,  who both raised concerns about loss of hours and services. 
* Requested that the Department of Social Services formalize its reporting of the IHSS Quality Assurance Initiative by April 30, 2007 and include stakeholders in its briefings of the findings and information collection regarding the initiative.  The subcommittee requested that, as part of this reporting, the Department respond to the three questions raised by stakeholders:
1. How many exceptions are processed by IHSS (county) supervisors after the social worker has completed the assessment /  reassessment;
2. Does Department of Social Services have data that compares the number of requests for appeals hearings prior to and after the adoption of the IHSS Hourly Task Guideline regulations;
3 How has the adoption of IHSS Hourly Task Guidelines affected the average number of hours approved per IHSS case? 


Subcommittee HearingAgenda Issue #4: Implementation Update on Direct Deposit for IHSS Workers (Providers)
Last year, AB 1808 (budget related or budget trailer bill dealing with social services) required Department of Social Services to expand its direct deposit system for all IHSS workers with a deadline to comply this year. 
Action Taken by Assembly Budget Subcommittee 04/11/07:
* Heard testimony from Department of Social Services and panel and one person from the public who mentioned about late payment of wages received in the mail. 
* Requested that the subcommittee staff be kept informed on the continuing efforts to reach implementation on direct deposit for IHSS workers (providers). 

Subcommittee Hearing Issue #5 IHSS Worker (Provider) Training 
* Proposed by advocates, this proposal would add to existing law, the authority that would allow IHSS workers (providers) to receive wages for training and would also direct the Department of Social Services to reprogram the computer system used for payment to allow for a payment line for in-service training.
* Proposed Trailer Bill (budget related) legislative language offered by California Association of Public Authorities, SEIU and United Domestic Workers:
Would amend 12301.6 of the Welfare and Institutions Code to do the following:
* Require the department, through all county letters, to inform Public Authorities, non-profit consortiums, and contract agencies providing IHSS services in counties if it learns of funding opportunities to provide additional paid provider training beyond the training required in current law.
* Require the department to pay particular attention to identifying funding that would pay for transition training for new providers.
* Require that If the representative of providers and an employer of record, through collective bargaining, agree that the employer of record shall use new funds to provide additional training beyond that required by current law, the agreement should ensure that the providers are paid through their payroll system.
* Require that enactment of paid provider training be independent of the CMIPS II procurement.
* Permit compensation for training using new funds to be authorized for any provider of in-home supportive services who provides transitional training to, or receives transitional training from, another provider of in-home supportive services in order to best meet the individual needs of a consumer who is changing providers.

Subcommittee Hearing Issue #6 IHSS Worker (Provider) Rate Proposal

Department of Social Services sets a "maximum allowable contract rate" or MACR for counties that use the "contract mode" as well as the "independent provider" (Public Authority) to deliver IHSS services. 
* The proposed budget related (trailer bill) language  would automatically adjust the maximum allowable contract rate in counties when a new wage is negotiated by Public Authorities, which would allow IHSS workers who work for contract agencies to negotiate wage inreases equal to those negotiated by indepenedent provider mode workers (providers). 
* The proposed legislative language language proposed by the California Association of Public Authorities is as follows:
"Add Section 12303.1 to the Welfare and Institutions Code to read:
The allowable cost of services provided under Section 12303 in each county that has negotiated or implemented a change or changes in wages or benefits for independent providers and in each county which pays independent providers the minimum wage shall be adjusted by the department by September 30 of the fiscal year following the effective date of the negotiated or implemented change in wages or benefits or the effective date of any change in minimum wage to reflect, at a minimum, the change in wages or benefits and the employer costs, including payroll taxes, directly arising from the change in wages or benefits

AB 1434  - MEDI-CAL:  HOME HEALTH AGENCY SERVICES 
AUTHOR: Assemblymember Mervyn Dymally (D)
CDCAN SUMMARY:
Would require the Department of Health Care Services (formerly Department of Health Services) to implement a ratesetting system, subject to federal approval and the availability of federal funds, that reflects the costs and services associated with quality home health agency services, under specific criteria in this bill (reflects 03/29/07 amendments).

CDCAN COMMENT: Though not specifically dealing with the In-Home Supportive Services (IHSS) which is largely a Medi-Cal funded program,  this bill does impact other home health care services also funded by Med-Cal for elgible persons.  Assemblymember Dymally says the bill is needed because currently, there is "no methodology for Medi-Cal  home health agency rates" and according to Dymally,  the last time home health agency rates were updated was in August 1, 2000, with a 10% increase as part of the state budget.

AB 1704 - DEVELOPMENTAL SERVICES  (FORMERLY IHSS)
AUTHOR: Assemblymember Doug La Malfa (R)
BACKGROUND: Prior to 04/10/07,  this bill would have made only minor changes in existing State law relating to the In-Home Supportive Services (IHSS) program and was a "spot bill" - meaning legislation that was holding a spot for more details that would be amended into the bill.  The bill was amended on 04/10/07 and no longer directly impacts IHSS, though about 20,000 children and adults with developmental disabilities are eligible and receive IHSS.  [see separate CDCAN Report on developmental services related bills)

SB 867 - IHSS: LONG TERM CARE INTEGRATION PILOT PROJECT
AUTHOR: State Sen. Mark Ridley-Thomas (D)
CDCAN SUMMARY (before 4/11/07 amendments): :    
* Would authorize a recipient who receives personal care and in-home services through a long-term care integration pilot project to select his or her own service provider, subject to program requirements.
* Would authorize a recipient who receives personal care and in-home services through Access for Infants and Mothers program (AIM), the Healthy Families Program, and the Major Risk Medical Insurance Program (MRMIP), or any publicly funded program enacted prior to or on or after January 1, 2008, to select his orher own service provider, subject to program requirements.

CDCAN COMMENT:
Existing State law allows for the Long-Term Care Integration Pilot Program to bring together the financing and administration of long-term care services in up to 5 pilot project sites in the state. This bill is somewhat similar in concept to previous legislation by Assemblymember Juan Vargas in 2005, and is intended to make sure that a recipient of IHSS services maintains their rights under such pilot programs.

The California Disability Community Action Network is a non-partisan network connecting  tens of thousands of Californians in every community, including people of color, people of every type of disability, including people with physical disabilities, people with developmental and other disabilities, people with traumatic brain and other injuries, people with mental health needs, seniors, people with MS, Alzheimer's and others, and families, community organizations and providers, in-home, direct care and other workers, and other advocates.
