AB 1768 SPECIAL EDUCATION BILL PASSES ASSEMBLY
EDUCATION COMMITTEE - WOULD REINSTATE "STAY PUT"
PROVISION DURING FAIR HEARINGS
SACRAMENTO (CDCAN) - AB 1768 by Assemblymember Noreen Evans (Democrat -
Santa Rosa) dealing with special education due process hearings "stay
put" provision, easily passed the Assembly Education Committee
this afternoon. The bill now heads for hearing in the Assembly
Human Services Committee. The hearing for that bill in Assembly
Human Services, chaired by Assemblymember Jim Beall (Democrat - San
Jose) is likely on April 15 (Tuesday), at 1:30 PM at the State
Capitol in Room 437.
The bill, supported by many parents of children with special needs,
including those with autism, would reinstate state law that would
require local school districts to continue to provide early
intervention services to a child with special needs who is no longer
eligible to receive those services and there is a dispute to continue
similar services under a preschool program.
The bill would require continuation of those services until the dispute
in a a fair hearing process has been resolved.
